You might be setting yourself up for a letdown by thinking paypal will get your money back. If they decide in your favour they will only award you what he has as "cash" in his paypal account. They are not a credit card company so they can't take it from his credit card.

The only ones that can do this is your credit card company. This is why i've said this many times threwout this thread.

(call YOUR credit card company directly) You just need to give them the transaction # that you will find on your cc statement.

I know first hand how the paypal claim process work as it happened to me. When they decided in my favour they told me they could only give mr $6.50 back out of $125 as thats all the seller had in his account. I didn't even respond back to paypal. Picked up the phone called my cc company told them i never received what i paid for. Easy call for them 10 business days later i got the full $125 charged back.

I did the exact same thing with Sylvester in December. I paid him threw paypal but with a cc. I didn't even file a claim with paypal. Picked up the phone and called mastercard. Took them 3 weeks to process the chargeback. I got the $150 i sent Sly back.

On another note i wonder how many times he has read these 2 threads.

Mods can you tell us if he has created a new username from the IP that MK2fanatic was registered under.

I bet he will create a new username and keep on scamming on this board.

i think the problem with going that route is that paypal freezes your account since they are the ones held accountable for the transaction

done it twice and never had my paypal account froze.

I get it now Joe. I hadn't even heard of such a thing, so i assumed you just filed a regular paypal claim. You should be ok then.

Yeah, paypal has a couple different "credit" options. They have their "paypal" credit card...and then Paypal Buyer Credit, which is essentially and online credit card service done through GE. I did file the regular paypal claim too, but I checked my purchase and it is able and eligible for chargeback if I need too...just waiting now.

Doing a little digging...finding more information and places where this guy is posting.

Found this site... and what is very interesting are some of the pictures he has up...many from objects that others have...not himself.
For instance...looking through the pictures I found a picture of my clean TDI head prior to building it for the mk1? I know its mine by looking at the bench and the items below it! Hey! thanks my bench in the basement...i was scratching my head as to why it is posted on his site.

Duane,

CAPS may have been a bit extreme and I am trying to deal with things in a manner in which I myself stay cool as well even though it really burns me inside. I've already gotten some good information and want to keep the thread from being locked...

So yeah...it might have been a bit harsh (and you'll see my reply as well that we must have posted close to at the same time) but I can understand what you are saying too. I'm glad to see that there is a buyer/seller forum and this is a forum that he uses frequently...so...

I believe even though i am from outside that community specifically, that we are a community of common interest...in this case, VW and therefore I think forum members would want to know.

Don't forget to let them know that there is another thread on here about screwed buyers besides yourself. I know you mentioned others, but didn't offer the thread. http://vwdiesel.net/phpBB/viewtopic.php?t=11709

Jim, I am adding this to my thread...
I know my thread connects to it...but an instant connection would be better.

Also, all of the suddent today, I have received an email from Slyvester.
I am trying to decided whether to post its contents...its very upsetting. Admitting to things, claiming financial hardships and he decided himself to cancel shipping and admits to covering it up and not communicating with me, etc. Very frustrating.

Probably no need posting it as we all know "the story" by now. Just save it in case you need it for later.

I was asked by some members to post this...and its what I'm talking about. I've omitted any personal information and don't mind the public seeing what he wrote...

Slyvester's email today...
Joe,

I honestly don't know what to tell you.  I guess the the easiest way to deal with this would be to work out
a way to arrange payment to you.  I understand you have been more than patient about this, and I am wrong
for what I have done to you.  This evening from 530 pm till 11 pm I will be available at this number where I will
call you from. _ _ _ _ _ _ _ _ _.  It's of no consequence to you, but my financial situation has drastically changed
and it forced me into a bad spot.  However I shouldn't have done what I did to you.  Your parts were arranged
to be shipped, but I had cancelled shipping because my costs had gone up, and I didn't have the money to
cover the difference.  It was wrong and I should have informed of this, but I chose instead to cover it up and
try to avoid contact with you.  As for not answering my cell phone, it is a pay as you go phone and I haven't
had my plan topped up.  That is why I haven't gotten any of your phone calls.  As for phone calls to my house,
if your number is unlisted it doesn't come up on the call display.  I've be away from home alot trying to earn an
income here and there, to come up with away to pay you.  Seeing as I haven't contacted you, I don't expect
you to believe any of this.

Like I said though I will be available from 530 -1130 at this number _ _ _ _ _ _ _ _ _I WILL call you tonight

Sylvester

My response to him...

Sylvester,

You may well have run out your options to this point. I find it interesting that you don’t “honestly” know what to tell me. Interesting…
You will need to make full payment back to me and it may need to be through legal means as I am building a case against you for these reasons and your fraudulent activities. I have been more than patient and you are indeed right that it is “wrong” what you have done. At this point, you have stolen money from me as evidenced by my none receipt of parts from you, your lack of communication and your fully disclosing here that you intentionally did that, and your decided to cancel shipping items to me that you owe me and have obviously used the money from already citing “higher shipping costs” to you, despite that we had agreed on a shipping amount SET by YOU!.
Your right…your financial situation is of no consequence to me as we all get into “finanacial” situations from time to time.  I am a graduate student, currently down to my wife’s income only as I am student teaching…so that is hard, but you know what…when I sell something, I make sure to use that money to get that item to them regardless. The fact of the matter here is that you engaged and agreed to send items to me for a price that you researched and set and then obviously went ahead and used the money for other things when in reality a portion of that money was ready and already set aside to reflect shipping.  This shows your character regardless of your “situation”
I’ve had a “pay as you go phone” and know how they work. Your messages can be checked,  and you did received a couple of my messages, each time I left my contact information….so that cannot be used as an excuse in not contacting me. I’ve also observed your activity on other forums and obviously you’ve figured this out today. So, you do have access…
It’s called disregard…

As far as contacting me, make sure it is prior to 10pm as I am up early the next day.
I have also collected other information regarding you and will be contacting the authorities to handle this through them as well.  I am considering other means as well legally especially considering the activity that you have engaged in.
I am indeed sorry that it has come to this, but these are the choices that you have made as a member and a seller. Your community, public and other forums deserve to know. The more I read, the more I discover that I am not the only one.

Again….disappointing…. there is no real excuse.

Joe
